In a recent turn of events, Sanjay Singh, the Rajya Sabha MP and AAP leader, has been granted bail by the Supreme Court after spending six months in jail in connection with the Delhi excise policy and PMLA case. The Enforcement Directorate (ED) did not oppose Singh’s release, pointing to exculpatory statements from an approver and the lack of money recovery.
Singh’s arrest stemmed from allegations of receiving Rs. 2 crores from a businessman’s employee, Dinesh Arora. Interestingly, Chief Minister Arvind Kejriwal is also detained in Tihar jail as part of the same case.
During his bail period, Singh is allowed to partake in political activities but is restricted from making any public statements regarding the case. This comes after the Delhi High Court had previously turned down Singh’s bail plea back in February.
The Supreme Court is now questioning the need for the attachment of proceeds of crime in bribery cases under the PMLA Act. The ED has been asked to reconsider Singh’s continued detention due to the lack of substantial evidence and the exculpatory statements provided.
In a significant development, Singh has been given permission to file his nomination for the Rajya Sabha elections set for January 8, 2024. Surprisingly, Singh took his oath as a Rajya Sabha MP on March 19 while still being incarcerated.
The court acknowledged Singh’s six-month stint in jail and granted him bail under specific terms and conditions outlined by the trial court. Furthermore, the Supreme Court is currently reviewing two special leave petitions challenging Singh’s arrest and remand, along with an application for bail.
